First things first:

You can revoke your consent and the settings you made when visiting the website and all its subpages at any time via the Didomi SAS Consent Management Platform (hereinafter “CMP tool”) used by us, either partially or completely, with effect for the future. To do this, please use the “Manage cookie settings” option at the bottom of the website.

I. What data does CW Europe Group Marbella S.L. process when you use the website?

In principle, you can use the website www.cwibiza.com with all its subpages (hereinafter collectively referred to as the “Website”) without registering or actively providing personal data. Further information can be found in our privacy policy, which you can find here, or in the privacy policies of the company websites of our respective licence partners. The privacy policies of our licence partners can be found at the bottom of the respective company page, which you can access via the URL www.luxuryvillasibiza.net.

When you visit the website, we or our licensing partners collect a limited amount of data about the device you use and your usage behaviour in connection with our offers. Neither we nor our licence partners can assign this data to an individual person. This includes the following data when you access a website:

Personal data that is transmitted by the user’s internet browser each time the website is accessed and stored as part of log files, also known as server log files. This data includes IP address (Internet Protocol address) of the accessing computer; name of the page accessed; date and time of access; URL from which the user accessed the page; amount of data transferred; notification of successful access; session identification number;

Personal data in the form of location data (GPS data, so-called “Locate Me” function), which is always transmitted by your Internet browser if you have activated this setting from the browser in principle or for specific applications.

II Use of cookies and other tracking technologies

1 What are cookies?

Like all other commercial websites, this website also uses so-called cookies and other tracking technologies (hereinafter collectively referred to as “cookies”).

Cookies are small text files that are stored locally in the main memory or on the hard drive of your computer or mobile device (hereinafter referred to as “end device”) and that fulfil a variety of functions and can process data for different purposes. When the respective website is called up again, the user’s browser reproduces the content of the cookies and thus enables the user to be recognised. Third-party technologies, such as scripts, pixels and tags that CW Europe Group Marbella S.L. integrates for advertising purposes, also install cookies on your end device. Some cookies are automatically deleted at the end of the browser session (so-called session cookies), others are stored in the user’s browser for a certain period of time or permanently and then automatically deleted (so-called temporary or permanent cookies). Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie that allows websites and servers to be assigned to the specific internet browser in which the cookie was stored. This enables the websites and servers visited to distinguish the individual browser of the data subject from other Internet browsers that contain other cookies. However, the cookie makes it possible to identify your end device.

A. Types of cookies

We use different types of cookies:

(i) So-called technically necessary cookies

Firstly, we use cookies that are technically necessary for the operation of the website. Technically necessary cookies are essential for the operation of the website, without them the website could not be used or could only be used to a limited extent. The user data collected by technically necessary cookies is not used to create user profiles. This also includes temporary cookies (session cookies). They do not collect any data from your computer and are automatically deleted as soon as you close your browser.

Technically necessary cookies are also used for the use of the Didomi SAS Service Provider’s Consent Management Platform (hereinafter “CMP tool”) to obtain your consent to the installation of cookies and the use of other tracking technologies.

Technically necessary cookies are “strictly necessary” cookies within the meaning of the ePrivacy Directive 2002/58 EC and do not require consent. For the area of application in the Federal Republic of Germany, the legal basis for their use is § 25 II TTDSG (Telecommunications and Telemedia Data Protection Act). Insofar as personal data is processed in this context, the legal basis is Art. 6 para. 1 sentence 1 lit. f) GDPR (legitimate interest).

(ii) So-called technically unnecessary cookies

There are also cookies that are not technically necessary. These cookies are used for a variety of purposes, e.g. to optimise the website, create user profiles and display interest-based advertising. Basically, you can say that they are used for analysis or marketing purposes.

If we use such cookies for analysis or marketing purposes, we process your data on the basis of your consent in accordance with Art. 6 para. 1 sentence 1 lit. a) GDPR. You give us this consent via the CMP tool. Alternatively, Art. 6 para. 1 sentence 1 lit. f) GDPR (legitimate interest) may also be the legal basis for such cookies for analysis or marketing purposes. Further details can be found in our CMP tool (you can access it via the “Manage cookie settings” option at the bottom of the website). Here we have listed in detail the purposes for which we use cookies for analysis or marketing purposes and on what legal basis. Further explanations can also be found below.

B. Management of cookies in our CMP tool

You can find out and decide for yourself which cookies are offered when using the website, by which service provider/partner (so-called “provider”), which of your data is processed and whether you wish to give your consent.

To enable you to make this informed decision, we use a cookie consent management procedure (the CMP tool described above), with which your consent to the use of cookies or to the processing and providers named in the cookie consent management procedure is obtained, you have the option of managing it and – if you wish – also revoking it. The declaration of consent is stored so that you do not have to repeat the request and can prove your consent in accordance with legal obligations. The storage can take place on the server or in a cookie (so-called “opt-in cookie” or with the help of comparable technologies) in order to be able to assign the consent to a user or their end device. Subject to individual information about providers of cookie management services, the following applies: Consent may be stored for up to 12 months. A pseudonymous user ID and information on the scope of consent (e.g. which categories of cookies or service providers) are created with the date of consent.

The CMP tool helps you to filter the various cookies, trackers and analysis tools used by us and, if applicable, our suppliers on a user-specific basis, to obtain an overview, to select them according to their processing purpose and, if desired, to deactivate them generally or individually. However, you cannot deactivate technically necessary cookies, trackers and analysis tools for the reasons described above.

To access this CMP tool (if necessary), click on “Manage cookie settings” (accessible via the option at the bottom of the website).

As explained above, you can also use the website without cookies and other technically unnecessary tracking mechanisms, both initially and later. In this case, only cookies, trackers and analysis tools that are technically necessary for the use of the website will remain.

Information on consent: Some of the services listed in the CMP tool are set up by our providers or we transfer your data to these providers. Further details can be found in our CMP tool.

Information on consent: Some of the services listed in the CMP tool transfer data to the United States. The data processing and protection of your data in the United States is not GDPR-compliant. The services/suppliers are subject to US law and may therefore be obliged to transfer data to US authorities or secret services if the legal requirements are met. Risks for you arise in particular from the difficulty of criminal prosecution, the lack of control over the further processing or transmission of your data and the aforementioned access by government agencies. Further details can also be found in our CMP tool.

To change your cookie settings in this regard or to object, please click on “Manage cookie settings” (accessible via the option at the bottom of the website).

C. Management of browser cookies

You can also deactivate the storage of cookies via your browser settings and delete cookies already stored in your browser at any time. Please note, however, that the website or online offering may not work or may only work to a limited extent without cookies. We also recommend that you visit the website www.YourOnlineChoices.com, where you can obtain information and assistance on the mechanisms of website tracking. A central opt-out option for various tools, especially those from US providers, can also be found at the following link: optout.networkadvertising.org.

2. summary of the purposes for which we set cookies or process personal data in the context of web tracking

a. To create individual offers of our services or the services of our licence partners

Provided that you have given your consent in accordance with Art. 6 para. 1 lit. a GDPR, we set cookies or process personal data such as your IP address or work with unique identifiers (a unique identifier, UID for short, is a unique identifier consisting of codes in the form of sequences of numbers and letters) to inform you about our services. In doing so, we also take into account your preferences resulting from your usage behaviour on our website.

In our CMP tool, you will find these cookies in the following sections:

Select custom content

A Storage of and access to geolocalisation data for targeted advertising purposes

b. Creation of usage profiles based on statistical analyses to adapt the website to your needs

We need statistical information about the use of the online offering on the website in order to make the website or its content more user-friendly and to conduct market research or reach analyses. We use web analysis tools (“tools”) for this purpose. Usage profiles are created with the help of analysis cookies or by analysing your log files. The providers of these tools process your data as processors in accordance with our instructions and not for their own purposes. The tools do not use the IP addresses of users and do not shorten them immediately after collection.

The legal basis may be your consent (if we process your personal data, Art. 6 para. 1 lit. a) GDPR; if we use cookies and do not process personal data, the legal basis is the ePrivacy Directive 2002/58 EC or, within the scope of application of the Federal Republic of Germany, § 25 II TTDSG). In addition, CW Europe Group Marbella S.L. may have an overriding legitimate interest in the needs-based and user-centred design of the website and in the statistical analysis of the website. The legal basis for data processing is then Art. 6, para. 1, lit. f) of the GDPR.

For the aforementioned purposes, we use cookies for the website and subpages, both our own cookies and those of third-party providers, which we transmit to your computer via your web browser. These enable our systems to distinguish your browser from others. On the one hand, we send you so-called persistent cookies. On the other hand, we use so-called session cookies, with the help of which you receive a session ID during your visit to our pages, with which we can distinguish you from other visitors to the website.

You will find these cookies in the following sections of our CMP tool:

    • Storing or accessing information on a device
    • Measuring the performance of content
    • Developing and improving products
    • Use market research to obtain information about the target group
    • Measuring the performance of adverts
    • Select basic adverts
    • Use accurate geographic location data
    • Actively analysing the characteristics of the device to identify it

In our CMP tool, you can also find the partners we work with in alphabetical order.

Some of the services listed in the CMP tool transfer data to the United States. Data processing and data protection in the United States do not comply with the General Data Protection Regulation. The services are subject to US law and may therefore be obliged to transfer data to US authorities or intelligence agencies if the legal requirements are met. The risks for you arise in particular from the difficulty of criminal prosecution, the lack of control over the processing or transmission of data and the aforementioned access by government agencies. Some providers, such as Google, may also process data for their own purposes. In these cases, data processing is based on your consent, Art. 6, I lit. a) of the GDPR.

Further details can also be found in our CMP tool (accessible via the “Manage cookie settings” option at the bottom of the website).

3. Links to social networks

Our website sometimes contains links to the pages of the most important social networks (e.g. Facebook and Twitter). In this sense, these are not social media plug-ins, but links where no personal data is transmitted to the operators of the social networks.

III. transfer of your personal data and, if applicable, transfer to non-EEA countries

Please refer to the information in our CMP tool to find out to what extent we exchange personal data with our partners and whether these partners are based in non-EEA countries.

Recipients of personal data may be located outside the EEA/UK. Where personal data is transferred to locations outside the EEA/UK, we will ensure, as required by law, that your data protection rights are adequately protected, either because the European Commission has decided that the country to which the personal data is transferred ensures an adequate level of protection (Article 45 of the GDPR) or because the transfer is subject to appropriate safeguards (e.g. standard contractual clauses) of the European Union agreed with the recipient (Article 46 of the GDPR), unless the GDPR provides for an exception (Article 49 of the GDPR). Furthermore, where necessary, we intend to agree additional measures with the recipients to ensure an adequate level of data protection. Copies of the appropriate safeguards (where we rely on them) and a list of recipients outside the EEA/UK may be requested. Please note that these copies may be redacted to protect trade secrets or other confidential information.

IV Storage and deletion of data

CW Europe Group Marbella S.L. will retain your personal data for as long as necessary to fulfil the purposes for which it was collected and processed, including for as long as is required by law (e.g. retention of accounting records). For further details on retention periods, please refer to our CMP tool.

V. Data protection

In our privacy policy you will find information about our responsibilities, our contact details and your rights in relation to data processing.
